Hutchinson Island homeowner George Wentworth will tear down the roof of his boat slip in the Indian River Lagoon and donate $6,000 to the Florida Oceanographic Society for an educational display under a settlement reached last week with the state Department of Environmental Protection.

The settlement, which ends a two-year dispute with DEP, requires Wentworth to remove the roof by Aug. 9, 2002, in part because it creates improper shade in the protected lagoon. The department filed suit in March against Wentworth, alleging he had not complied with an order to remodel the 661-square-foot terminal platform at the end of his dock.

The state held that the structure could be no larger than 160 square feet because it is in an aquatic preserve.
